Posting inspections in Italy, what inspectors look at

Italian enforcement on transnational posting does not hunt for one decisive document, it looks for a coherent picture. Inspection bodies make an overall assessment of all the elements of the case (Article 3(1), Legislative Decree 136/2016). Those elements are listed by the law itself, and it pays to know them before a report lists them for you.

The indicators on the posting company

On the company side inspectors look at where the registered and administrative seat are and where business is really carried out, registration in registers or professional rolls, where workers are hired and posted from, the law governing contracts with clients and staff, turnover and the number of contracts performed in the State of establishment. A company producing nothing at home is the heaviest indicator of all.

The indicators on the posted worker

On the worker side what counts is the content, nature and pay of the activity, the fact that habitual work takes place in the home State, the temporary nature of the work in Italy, the start date, the expected return, who bears travel, board and lodging, previous posting spells on the same position and the social security certificate. No single element is decisive, the law requires an overall reading and forbids stopping at the formal datum.

How the check unfolds and what comes out of it

The investigation runs through the contact person domiciled in Italy, who is asked for the documentation file, and through cooperation with the authorities of the State of establishment via the European IMI system. The inspection weeks coordinated by the European Labour Authority, in which Italy takes part, feed the same circuit.

The 2026 picture confirms the trend. Coordinated action weeks reached 128 companies in construction and 2,294 in the undeclared-work strand, with over 700 suspected irregularities, and non-genuine postings sit firmly among national enforcement priorities. Investigations increasingly start from cross-border referrals, not random visits.

If the posting proves non-genuine, poster and user are each fined 50 euros per worker per day of employment, with a minimum of 5,000 and a maximum of 50,000 euros, and the employment relationship is attributed to the party that used the work. Where minors are involved the breach becomes criminal, with detention of up to eighteen months and the fine increased up to sixfold.

Frequently asked questions

Can Italian inspectors request documents directly abroad?

Requests go through the contact person domiciled in Italy and through administrative cooperation with the State of establishment via IMI. An unresponsive contact person is therefore a double problem.

Does a valid A1 certificate close the check?

No. The A1 concerns social security only, while genuineness is assessed on the full set of Article 3 indicators, none of which is decisive alone.
