Posting over 12 months in Italy, what changes automatically

Past twelve months a posting to Italy switches regime with no order needed. Article 4-bis of Legislative Decree 136/2016, implementing Directive (EU) 2018/957, provides that where the actual duration of a posting exceeds twelve months, posted workers are entitled, where more favourable, beyond the core guaranteed from day one, to all working and employment conditions provided in Italy by law and collective agreements.

What stays out even after twelve months

The switch to full treatment knows three exceptions only, procedures and conditions for concluding and terminating the employment contract, non-compete clauses, and supplementary occupational pensions. Everything else in Italian rules, including pay items and the institutes of national and territorial collective agreements, enters the favourability comparison.

The practical effect bites mostly at collective level. Past the threshold the comparison absorbs institutes the initial core does not cover, starting with territorial bargaining, the three exceptions above remaining firm, and the cost of the posting must be re-budgeted. Which is why the threshold should be tracked from day one, counting extensions and interruptions.

The notification that takes the limit to 18 months

The limit is not rigid. Upon a reasoned notification to the Ministry of Labour by the service provider, the period is extended up to a maximum of 18 months (Article 4-bis(2)). The notification must be reasoned and filed before the twelve months mature, because once the threshold is crossed the full regime has already applied. It requires no ministerial assent, though the reasoning remains reviewable on inspection.

Counting the months and the anti-replacement rule

What counts is actual duration, not what the prior declaration stated. And duration does not reset by changing person, where one posted worker replaces another on the same task in the same place, the periods add up towards the threshold.

Finally, keep the planes apart. The twelve months of Article 4-bis concern working conditions, the twenty-four months of Article 12 of Regulation (EC) 883/2004 concern social security and the A1. A posting can pass twelve months while remaining in home social security, and the two clocks must be managed separately.

Frequently asked questions

Is the extension to 18 months automatic?

No, it requires a reasoned notification to the Ministry of Labour by the service provider. Without it the full regime applies once twelve actual months are exceeded.

Does a 24-month A1 move the 12-month limit?

No. The A1 governs social security legislation only, while working conditions follow Article 4-bis. The two counts run in parallel and both need monitoring.
