What differs between Spain and Italy

Spanish employers operate under a two-level collective system (Convenios Estatales and Convenios Provinciales / de Comunidad Autónoma) where the provincial level often prevails on pay matters. When posting to Italy, the comparison is simpler in form (one CCNL per sector) but more delicate in substance: the Italian sectoral CCNL applies on the basis of the work actually performed in Italy, regardless of the Spanish convenio.

Joint liabilityArt. 42 Estatuto de los Trabajadores + Art. 16-ter Ley 45/1999Art. 4 D.Lgs. 136/2016 + Art. 29 D.Lgs. 276/2003 (construction) + Art. 1676 Italian Civil Code

The biggest sanction risk for Spanish posting employers is the incorrect identification of the Italian CCNL and the consequent underpayment versus the Italian sectoral minimum (€25–50 per worker per day, up to €150,000). For a construction job in Italy, the CCNL Edilizia applies — even where the Spanish firm runs under the Convenio Estatal de la Construcción.

Mapping the Spanish Convenio Colectivo to the Italian CCNL

Construction — Convenio General del Sector de la Construcción → CCNL Edilizia (Industria/Artigianato)

Posting albañiles, encofradores, ferrallistas, peones to an Italian construction site falls under CCNL Edilizia, 7 levels (1° comune to 4° specializzato), mandatory contributions to the Cassa Edile, DURC compliance, stricter joint-liability regime (art. 29 D.Lgs. 276/2003).

Metallurgy — Convenio Colectivo del Metal → CCNL Metalmeccanico Industria

For industrial assemblies or commissioning in Italy: CCNL Metalmeccanico Industria (Federmeccanico), 2021 grid (D2/D3/C3/C2/C1/B3/B2/B1/A1). Note: greenfield assemblies usually fall under CCNL Edilizia. Spanish provincial Convenios del Metal often have higher minima than the Estatal — the comparison must use the actually-applied tabla salarial.

Cleaning — Convenio del Sector de Limpieza → CCNL Pulizie / Multiservizi

For industrial or commercial cleaning in Italy: CCNL Pulizie / Multiservizi, levels 1° to 7°, CCNL shift and night premiums. Spanish complementos salariales (antigüedad, nocturnidad) must be re-mapped under Italian rules.

Pagas extraordinarias and Italian extra months — enveloppe comparison

Spanish pagas extraordinarias (typically 2 per year, sometimes prorrateadas) functionally correspond to Italian 13th and 14th-month pay (mensilità aggiuntive) provided by most CCNLs. They are included pro rata in the Italian minimum. Note: in Spain, prorrateo (monthly distribution) is common; in Italy 13th/14th-month pay is paid as a separate lump sum — payslip format differs but the gross figure is what counts for compliance.
