What differs between Poland and Italy
Polish employers operate under a system that combines a statutory minimum wage (minimalne wynagrodzenie za pracę) with sectoral collective agreements that have limited erga omnes effect. When posting to Italy, the wage benchmark shifts entirely to the Italian sectoral CCNL of the destination sector, which typically sets minima significantly above the Polish levels. This wage gap is the main compliance risk — and the main reason inspections target PL→IT postings.

The biggest sanction risk for Polish posting employers is not the missed notification, but the incorrect identification of the Italian CCNL and the consequent underpayment versus the Italian sectoral minimum (€25–50 per worker per day, up to €150,000). The wage gap between Polish and Italian minima makes the Italian client particularly attentive to joint-liability exposure — robust upfront documentation is non-negotiable.

Construction — Polish construction wage system → CCNL Edilizia (Industria/Artigianato)
Posting murarze, cieśle, monterzy, pomocnicy to an Italian construction site falls under CCNL Edilizia, 7 levels (1° comune to 4° specializzato), mandatory contributions to the Cassa Edile, DURC compliance, stricter joint-liability regime (art. 29 D.Lgs. 276/2003). The wage gap PL→IT is significant: the Italian minimum often exceeds the Polish gross by 30–60% before holiday and 13th/14th-month allowances.
Manufacturing — Polish manufacturing system → CCNL Metalmeccanico Industria
For industrial assemblies or commissioning in Italy: CCNL Metalmeccanico Industria (Federmeccanico), 2021 grid (D2/D3/C3/C2/C1/B3/B2/B1/A1). Note: greenfield assemblies usually fall under CCNL Edilizia.
Logistics and road transport — Polish logistics system → CCNL Logistica, Trasporto Merci e Spedizione
For road transport and logistics services in Italy, the CCNL Logistica applies, with attention to the rules of the Mobility Package (cabotage, returns) and to specific cabotage limits. Drivers performing cabotage operations are subject to host-country rules from day one.
Non-EU workers in the posting team
Polish employers frequently post teams that include non-EU workers (Ukrainian, Belarusian, etc.) regularly employed in Poland. To post these workers to Italy, the Italian residence and work-permit framework (art. 27 co. 1-bis T.U. 286/1998) must be checked carefully, and the Polish documentation justifying their employment must be available in Italian translation. This is a frequent compliance gap during INL inspections.
