What differs between Austria and Italy

Austrian employers are used to a quasi-universal Kollektivvertrag system (~98% coverage) and to a strict inspection regime (LSD-BG, Finanzpolizei). When posting to Italy, they meet a different regulatory environment: no statutory minimum wage, but sectoral CCNLs; a centralised pre-posting notification at the Italian Ministry of Labour; client joint liability that is particularly tough in construction.

The biggest sanction risk for Austrian posting employers is the incorrect identification of the Italian CCNL and the consequent underpayment versus the Italian sectoral minimum (€25–50 per worker per day, up to €150,000). For a construction job in Italy, the CCNL Edilizia applies — even when the Austrian firm runs under the Metallindustrie KV.

Mapping the Austrian Kollektivvertrag to the Italian CCNL

Construction — KV Bauindustrie/Baugewerbe → CCNL Edilizia (Industria/Artigianato)

Bricklayers, formwork carpenters, ironworkers, labourers on an Italian construction site fall under CCNL Edilizia, 7 levels (1° comune to 4° specializzato), mandatory contributions to the Cassa Edile (the Italian counterpart of BUAK), DURC compliance, stricter joint-liability regime (art. 29 D.Lgs. 276/2003).

Manufacturing — KV Metallindustrie / Metallgewerbe → CCNL Metalmeccanico Industria

For industrial assemblies or machine commissioning on an existing Italian site, the CCNL Metalmeccanico Industria (Federmeccanico) applies, with the 2021 grid (D2/D3/C3/C2/C1/B3/B2/B1/A1). Note: assemblies on a greenfield construction site usually fall under CCNL Edilizia.

Sonderzahlungen ↔ Italian 13th and 14th-month pay

Austrian Sonderzahlungen (13th/14th) functionally correspond to the Italian 13th and 14th-month pay (mensilità aggiuntive) usually provided by the CCNL. They are included pro rata in the Italian minimum. Note for the comparison: in Austria Sonderzahlungen enjoy a tax-favoured regime; in Italy this fixed advantage doesn't exist — the gross figure is the relevant one.

BUAK ↔ Cassa Edile

Austrian BUAK has an Italian counterpart: the Cassa Edile, organised by province, with mandatory contributions throughout the construction job. Contributions paid to BUAK in Austria do not cover the Italian Cassa Edile obligation — the duty cumulates.
